This AUP governs your use of the Hellopyme web hosting service. Violation of this AUP may result in the suspension or termination of your service. In the event of a dispute between you and Hellopyme regarding the interpretation of this AUP, Hellopyme's interpretation, in its reasonable commercial judgment, will govern.

The following is the Acceptable Use Policy ("AUP") all agreements between Hellopyme and the personal or corporate account holder. Hellopyme offers World Wide Web Hosting and installation of scripts. Hellopyme has certain legal and ethical responsibilities consistent with the use of its servers and equipment used for these services. Hellopyme's general policy is to act as an Internet presence provider. Hellopyme reserves the right to suspend or terminate a customer's access to Hellopyme services when we decide that the account has been used inappropriately.

What is Intended Use?

Hellopyme is designed to meet the web hosting needs of small, independently owned and operated businesses in a single country. It is not appropriate to use our services to support large enterprises or internationally based businesses with sustained demand that places an undue burden on our systems or negative effects for use by small, independently owned and operated businesses.

Hellopyme is a shared web hosting service, which means that a number of customers' websites and other mail accounts or storage services are hosted on the same server. Hellopyme uses abuse controls to help ensure that use of our services does not adversely affect the performance of our system or other customers' sites. It is not appropriate to use an account primarily as an online storage space or for archiving electronic files.

Disk Space

If you use your services consistently with the Terms of Use and these paragraphs, your site can grow as large as necessary to meet your small business needs, but to ensure a great experience for everyone, we will place some restrictions on how fast you can grow. The vast majority of our clients' sites grow at rates well within our rules, but our abuse controls may cause a slight delay while we evaluate whether expansion is appropriate for your particular plan.

Hellopyme Customers cannot execute the following (below), if a customer does Hellopyme can cancel the account without refund. Depending on the situation in that country warnings will / will not be sent.

a) Using 25% or more of the system CPU resources for more than 90 seconds or 1% of the servers CPU resources for more than 5 minutes. There are numerous activities that could cause such problems, including: CGI scripts, FTP, PHP, HTTP, etc.

b) Using any type of distributed computing software, including but not limited to SETI @ home, Node Zero and Folding @ home.

c) Running any type of real-time interactive chat applications that require server resources. Remotely hosted services are fully permitted.

d) Run stand-alone, server processes at any time on the server. This includes all daemons.

e) Run any software that interacts with an IRC (Internet Relay Chat).

f) Run any file sharing, bit torrent or other P2P network services, client or server software.

g) Run any game server such as Counter-Strike half-life, Battlefield 1492 etc.

Bandwidth

In most cases, if you use our services in a manner consistent with our Terms of Use, visitors to your site will be able to download and view as much content from your site as they like. However, in certain circumstances, our server controls processing power, server memory, or abuse could limit downloads from your site. You will always be able to use the full width that your account has. For example our Professional Plan comes with a bandwidth of 100GB which is a huge amount, all of this 100GB can be used. The bandwidth is also reset every month.

You are allocated a monthly bandwidth maintenance allowance. This allotment varies depending on the hosting package you purchase. If your account goes over the allotted amount we reserve the right to suspend the account until the start of the next allotment, suspend the account until more bandwidth is purchased or an additional fee is charged, suspend the account until you upgrade to a higher tier of the package, terminate the account and/or charge you an additional fee for overages. Transfer not used in one month may not be carried over for the next month.

Email Storage

You do not have to worry about a storage limit if you use our services in accordance with the Terms of Service and our acceptable use policy. Hellopyme will increase your space along with your corresponding small business needs, but our abuse controls may affect the growth rate or size of your folder, and there may be a small delay while your usage is evaluated. In some cases, creating additional folders or subfolders will help ensure that the system works well for everyone. You are always allowed to use the disk space applied to your account.

Unlimited

You may have noticed that all of our accounts come with unlimited email accounts, in some cases, domains, FTP and subdomains. This is subject to the amount of disk space your account has. So you can create as many emails, subdomains, etc, as you want, as long as it is within your disk space limit.

Offensive Content

You may NOT post or transmit through the Hellopyme service any content that Hellopyme constitutes reasonable grounds:

(a) constitutes child pornography;

b) constitutes pornography vexatious;

c) is excessively violent, incites violence, threatens violence or contains harassing content or incitement to hatred;

d) is unfair or deceptive under any site's consumer protection laws, including chain letters and pyramid schemes;

e) is defamatory or violates a person's privacy;

f) creates a risk to a person's safety or health, creates a risk to public safety or health, endangers national security, or interferes with an investigation conducted by law enforcement;

g) improperly exposes the trade secrets or other confidential or proprietary information of another person;

h) is intended to assist others in defeating technological copyright protections;

i) clearly infringes another person's trademark or service mark, patent or other proprietary right; j) promotes illegal drugs, violates another person's trademark or service mark, patent or other proprietary right;

j) promotes illegal drugs, violates export control laws, engages in illegal gambling or illegal arms trafficking;

k) is illegal or engages in conduct that is illegal under laws applicable to you or Hellopyme;

l) otherwise malicious, fraudulent, or may result in retaliation against Hellopyme offended visitors;

Hellopyme does not accept material such as:

(a) Proxy, Warez, escrow, High Yield Investment Programs (HYIP), Illegal gambling and lottery sites.

Safety

You should take reasonable security precautions. You should protect the confidentiality of your password, and you should change your password periodically.

Bulk Commercial Email

Bulk commercial email, email distribution lists and reflectors are allowed on Hellopyme servers, and allowed a maximum of 600 emails (specialist plan) per hour per account. For emails sent from your Hellopyme account must comply with the following rules:

(a) Your recipients have given their consent to receive email through some affirmative means, such as an opt-in;

b) Your procedures for requesting consent include reasonable means to ensure that the person giving consent is the owner of the e-mail address for which consent was given;

c) You may not conceal the origin of your e-mail in any way.

d) Otherwise comply with the CAN SPAM law and other applicable laws.

These policies apply to messages sent using your Hellopyme service, nor to messages sent from any network by you or anyone on your behalf, that directly or indirectly refer the listener to a site hosted through your Hellopyme service. In addition, you may not use a third party email service that does not practice similar procedures for all of its customers.

Unsolicited E-mail

You may not send any unsolicited email, either in bulk or individually, to anyone who has indicated that they do not wish to receive it. You must comply with the rules of any other network that accesses or participates in the use of your Hellopyme service.

Copyrighted Material

You may not post, distribute, or copy in any way any music, software, art, or other copyrighted work unless:

(a) you have been expressly authorized by the copyright holder for the work to copy the work in that manner.

b) that it is allowed by the copyright law established in Spain to copy the work in that way.

Hellopyme will terminate the service of repeat copyright infringers.

Another

You must have valid and current information on file with your domain name registrar for a domain hosted on the Hellopyme network.

Disclaimer

Hellopyme has no obligation, and does not by this Acceptable Use Policy undertake an obligation, to supervise or monitor the activities of our customers and disclaims any liability for any misuse of the Hellopyme network.

Internet Abuse

You may not engage in illegal, abusive or irresponsible behavior, including:

(a) unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or breach security or authentication measures (including those of Hellopyme and its customers) without express authorization from the owner of the system or network;

b) monitoring of data or traffic of any network or system without the authorization of the owner of the system or network;

c) Interference with service to any user, host or network, including, without limitation mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks;

d) Use of an Internet account or computer without the owner's authorization, including, but not limited to Internet browsing (tricking other people into releasing their passwords), password theft, security hole scanning, and port scanning;

e) Forging any TCP-IP packet header or any part of the header information in an email or newsgroup; or

f) Any conduct that may result in retaliation against the Hellopyme network.

g) Use of the Hellopyme network in a manner that unduly interferes with other Hellopyme customers.

Newsgroups, discussion forums, other networks.

You must comply with the rules and conventions for postings to any bulletin board, group chat or other forum in which you participate, such as IRC and USENET groups, including their rules for content and commercial postings. These groups usually prohibit the posting of off-topic commercial messages or mass postings to multiple forums.
